END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a binding legal contract between Software Flow Yard SRL ("Developer") and you, the user ("End-User").

1. Acknowledgement: This Agreement is concluded between Software Flow Yard SRL and the End-User only, and not with Apple Inc. ("Apple"). Software Flow Yard SRL, not Apple, is solely responsible for the Licensed Application and the content thereof.

2. Scope of License: The license granted to the End-User is a non-transferable license to use the application on any Apple-branded products that the End-User owns or controls as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Maintenance and Support: Software Flow Yard SRL is solely responsible for providing maintenance and support services. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.

4. Warranty: Software Flowyard SRL is solely responsible for any product warranties. In the event of any failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation.

5. Product Claims: Software Flow Yard SRL, not Apple, is responsible for addressing any claims relating to the Licensed Application, including product liability, legal/regulatory compliance, or consumer protection claims.

6. Intellectual Property Rights: In the event of any third-party claim of intellectual property infringement, Software Flow Yard SRL, not Apple, will be responsible for the investigation and defense of such claims.

7. Legal Compliance: You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Beneficiary: Software Flow Yard SRL and the End-User acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that Apple will have the right to enforce this EULA against the End-User.
